Terms & Conditions

These Terms & Conditions (the "Terms") govern the use of all the services provided by TRAVEL MONEY SAS, a simplified joint-stock company (société par actions simplifiée) incorporated under French law (the "Company" or "Travel Money" or "TM"), and its parent company Travel Money Inc., a Delaware corporation ("TM Inc.").

By using any Travel Money platform or service, including mobile applications, website, browser extensions, or any related software, product or service (together, the "Platform"), you (the "Customer" or "Member") acknowledge that you have read, understood, and accepted these Terms.

1. Purpose and Scope

Travel Money operates as a membership-based concierge purchasing service (the "Travel Money Concierge" or "TMC") providing the following activities:

(a) Purchasing and Export-Resale Services: Acquiring goods from French and European retailers, merchants, and brands, and reselling them to Members at VAT-exempt export prices, with delivery arranged to the Member's address outside the European Union. This activity is carried out in accordance with French tax ruling Rescrit RI n° 2026-19 and includes managing export process, documentation, customs formalities, shipping, and any applicable import fees or tariffs.

Access to the TMC purchasing services requires an active TravelMoney membership (see Section 3).

2. Definitions

For the purposes of these Terms:

"Goods" means physical, non-consumable goods that Travel Money acquires from retailers and merchants and resells to the Member, with a view to export and delivery outside the European Union.

"Membership" means the paid annual subscription that grants access to TravelMoney purchasing and concierge services.

"Member" means any individual who holds an active TravelMoney Membership.

"Purchase Authorization" means the mandate and authorization granted by you to Travel Money, empowering Travel Money to acquire Goods on your behalf for immediate resale to you.

"Service Fee" or "Commission" means the fee charged by Travel Money for providing purchasing, logistics, export, and concierge services.

"Export Delivery" means the shipment and delivery of Goods to your designated address outside the European Union, qualifying as an export exempt from French VAT pursuant to Article 262-I of the French Tax Code.

"Referral Program" means the rewards program through which Members can earn credits by referring new customers to the Service.

3. Membership

3.1 Membership Required

Access to TravelMoney's purchasing and concierge services requires an active paid Membership. Membership is offered on an annual basis.

3.2 Membership Fee

The standard annual Membership fee is $495 (USD). This fee is charged at the time of enrollment and upon each annual renewal. Membership fees are non-refundable except as expressly provided in Section 11.

3.3 Membership Tiers

TravelMoney offers the following Membership tiers: Insider, Jetsetter, Globetrotter, and First Class. Each tier provides varying levels of access, benefits, and purchasing capabilities as described on our website. Travel Money reserves the right to modify tier benefits with 30 days' notice to existing Members.

3.4 Auto-Renewal

Unless you cancel your Membership prior to the renewal date, your Membership will automatically renew at the then-current annual rate. You may cancel auto-renewal at any time through your account settings or by contacting support@travelmoney.app.

3.5 Price Changes

Travel Money may update Membership pricing from time to time. Existing Members will be notified at least 30 days before any price change takes effect on their next renewal.

3.6 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

4. Referral Program

4.1 Overview

The Referral Program allows existing Members to earn rewards by referring new customers to TravelMoney.

4.2 Referrer Rewards

For each successful referral (defined as a referred individual who purchases a TravelMoney Membership), the referring Member receives a $100 credit applied to their TravelMoney account. Additional milestone bonuses and spend-based bonus layers may be available as described on our website.

4.3 Referee Benefits

New customers who sign up through a valid referral link receive 10% off their first-year Membership fee plus an additional $50 credit towards their first order.

4.4 Program Rules

  • Referral credits are non-transferable and have no cash value.
  • Self-referrals are prohibited.
  • Travel Money reserves the right to void credits obtained through fraud, manipulation, or violation of these Terms.
  • The Company may modify, suspend, or terminate the Referral Program at any time with reasonable notice.
  • Referral rewards may be subject to applicable tax reporting requirements.

5. Customer Eligibility

The TravelMoney Concierge services are strictly reserved for customers who are:

  • established and residing outside the European Union;
  • acting as final consumers purchasing for personal use;
  • requesting delivery of Goods outside the European Union; and
  • holding an active TravelMoney Membership.

Travel Money may request any information or documentation necessary to verify eligibility.

6. Legal Nature of the Service

When you engage TravelMoney Concierge services, the following legal relationship applies:

(a) Purchase Authorization: You authorize Travel Money to acquire Goods on your behalf from French merchants. Depending on the modality (see Section 7), you may pay the merchant directly under a purchase mandate, or Travel Money may purchase directly.

(b) Resale to Customer: In all cases, Goods acquired are immediately resold by Travel Money to you as an export sale exempt from French VAT. A resale invoice is issued by Travel Money in your name.

(c) Logistics Coordination: Travel Money arranges for the physical export and delivery of Goods to your designated address outside the European Union, including customs formalities via the electronic export declaration system.

(d) Service Fee Structure: Travel Money charges a Service Fee (Commission) for providing purchasing, logistics, and concierge services, which is separate from and in addition to the purchase price of the Goods.

7. How the Service Works

7.1 Service Request

You submit a request through the Platform specifying the Goods you wish to purchase. By submitting this request, you grant Travel Money a Purchase Authorization to acquire the requested Goods and arrange their export to your address.

7.2 Modality A: Customer Pays Merchant

Under this modality, you pay the French merchant directly on Travel Money's behalf under a purchase mandate. The purchase invoice is issued to Travel Money SAS. Travel Money then immediately resells the Goods to you at the VAT-exempt export price, invoices you for the product price (excluding VAT), its Commission, shipping, and any applicable duties or taxes, and arranges export and delivery to your address outside the EU. The VAT originally included in the merchant price is offset against the amounts you owe, with any difference settled between you and Travel Money.

7.3 Modality B: Travel Money Pays Merchant

Under this modality, you submit a purchase order and pay an advance to Travel Money. Travel Money purchases the Goods directly from the French merchant, paying the VAT-inclusive price. Travel Money then immediately resells the Goods to you at the VAT-exempt export price, invoices you for the product price (excluding VAT), its Commission, shipping, and any applicable duties or taxes, and arranges export and delivery to your address outside the EU. Your advance is offset against the final invoice, with any remaining balance settled between you and Travel Money.

7.4 Payment Structure

You will be invoiced by Travel Money for:

  • Product purchase price (excluding VAT)
  • Service Fee / Commission
  • Shipping and logistics costs
  • Insurance costs (if elected)
  • Foreign customs duties and taxes (where paid on your behalf)

7.5 Pricing Disclaimer

All prices, rates, savings percentages, savings estimates, and product examples displayed on the Platform, in marketing materials, social media, emails, advertisements, or any other communication channel are indicative and subject to change at any time without notice. Savings percentages shown in the product interface, on the website, in promotional materials, or in any other context (for example, "save up to 30%" or similar claims) are estimates based on conditions at the time of publication and are not guaranteed. Changes may result from, but are not limited to: fluctuations in foreign exchange rates, changes in retail pricing by merchants or brands, changes in applicable VAT rates or customs duties, changes in shipping or logistics costs, product availability, or corrections of errors.

The final price and actual savings payable by the Member will be confirmed at the time of checkout. Travel Money does not guarantee that any price, rate, savings percentage, or savings estimate shown at any point prior to checkout will remain available. Any product examples referenced in marketing (for example, specific handbag models or brand items at specific prices or savings levels) are illustrative only and do not constitute a binding offer at any stated price or savings rate.

7.6 VAT Treatment and Export Exemption

VAT Deduction: Travel Money deducts VAT paid on purchases from French merchants in accordance with Article 271 of the French Tax Code and the confirmation in Rescrit RI n° 2026-19. This applies even where the purchase payment is made by the Member under a mandate (Modality A).

Export Exemption: The resale of Goods to you outside the European Union constitutes an export exempt from French VAT pursuant to Article 262 I 1° of the French Tax Code.

Commission Exemption: The Service Fee (Commission) charged to you as a non-EU resident is exempt from VAT as a service directly related to an export, in accordance with Articles 262 I 1° and 257 ter of the French Tax Code.

Ancillary Services: Transport costs, insurance, and customs duties invoiced to you are likewise VAT-exempt as services ancillary to the main export operation.

TravelMoney does not provide a direct VAT refund to you. VAT savings result from the export exemption mechanism and are incorporated into the pricing structure.

8. Export Logistics and Proof of Export

Travel Money coordinates the transport and export formalities through professional express freight companies. The freight company receives the Goods at its logistics warehouse in France, handles French customs export declarations via the Delt@ electronic system, and ensures physical delivery to the Member's address outside the EU. Travel Money retains the electronic export declaration (Delta certification bearing the mention "Sortie") as proof of export for VAT purposes.

9. Customer Obligations

You undertake to:

  • Provide accurate and complete information regarding your eligibility, orders, and delivery details.
  • Maintain an active Membership in good standing.
  • Comply with all payment obligations in a timely manner.
  • Ensure that your use of the services complies with all applicable tax, customs, and import/export regulations in your jurisdiction.
  • Refrain from any use of the services that would violate these Terms or applicable laws.
  • Not use the Referral Program in a fraudulent or manipulative manner.

10. Brand Policies and Restrictions

Many luxury brands maintain policies restricting unauthorized resale of their products. TravelMoney's purchasing operations are structured to comply with applicable brand policies and distribution agreements. You acknowledge that you are purchasing Goods for personal use and not for commercial resale. Travel Money reserves the right to decline service requests that may violate brand policies, trademark rights, or applicable laws.

11. Liability

Travel Money's liability is limited to direct damages proven to result from a breach of these Terms, subject to applicable mandatory law. Travel Money shall not be liable for:

  • the quality, authenticity, or fitness for purpose of Goods purchased from third-party merchants;
  • acts or omissions of merchants, manufacturers, or logistics providers beyond Travel Money's reasonable control;
  • customs delays, duties, or import restrictions imposed by your destination country; or
  • changes in merchant availability, pricing, or policies.

Travel Money will use commercially reasonable efforts to assist you in resolving issues with purchased Goods, including facilitating returns in accordance with merchant policies.

12. Force Majeure

Travel Money shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond Travel Money's reasonable control. Such circumstances include, but are not limited to: natural disasters, epidemics, pandemics, acts of war or terrorism, civil unrest, government actions or sanctions, trade embargoes, changes in applicable law or regulation, customs authority actions or delays, carrier or logistics disruptions, merchant or brand supply interruptions, labor disputes, power or telecommunications failures, cyberattacks, and disruptions to banking or payment systems.

In the event of a force majeure event, Travel Money will use reasonable efforts to notify affected Members promptly and to resume performance as soon as practicable. If a force majeure event continues for more than 60 days, either party may terminate the affected order or service request without liability, and Travel Money will refund any amounts paid for Goods not yet delivered.

13. Cancellation and Returns

13.1 Membership Cancellation & Refunds

You may cancel your Membership at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused portions of a Membership term, except where required by applicable consumer protection law. Membership refunds are only allowed within 7 days of purchase.

13.2 Membership Cancellation by Travel Money

Travel Money may suspend or terminate your Membership for violation of these Terms, fraudulent activity, abuse of the Referral Program, or misuse of the Service. Outstanding referral credits will be forfeited upon termination for cause.

13.3 Order Cancellation

You may cancel a service request before Travel Money has completed the purchase. Cancellation fees may apply if costs have already been incurred.

13.4 Returns

Once Goods have been purchased, returns are accepted only for items damaged during shipping or materially different from the description. Return requests must be submitted within 14 days of delivery.

14. Intellectual Property

All intellectual property rights in the Platform, including trademarks, logos, and content, belong to Travel Money or its licensors. You may not use Travel Money's intellectual property without prior written consent.

15. Data Protection and Privacy

Travel Money processes your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for detailed information on data collection, use, and your rights.

16. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to their validity, interpretation, or performance shall fall within the exclusive jurisdiction of the competent courts of Paris, subject to mandatory consumer protection rules applicable in your jurisdiction.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute by contacting Travel Money's support team. We will work in good faith to resolve the matter within 30 days.

17.2 Applicable Forum

If informal resolution fails, disputes shall be submitted to the competent courts of Paris, France, except where mandatory consumer protection rules in your jurisdiction require otherwise.

18. Amendments

Travel Money may update these Terms from time to time. The version in force is the one published on the Platform. Material changes will be notified to Members via email at least 7 days before taking effect. Continued use of the services after any amendment constitutes acceptance.

19. Severability and Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, Cookie Policy, and any specific service terms, constitute the entire agreement between you and Travel Money.
